Debarshi, is a partner based in Delhi office of the firm and focusses on litigation, arbitration and contentious advisory work. He specialises in complex high-value disputes, and undertakes a range of contentious work on behalf of domestic and foreign corporations.
He acts for a range of project owners, institutional investors, project sponsors, developers, occupiers, contractors and sub-contractors, financiers, consultants and suppliers on both contentious and non-contentious projects. He also advises and represents a diverse clientele including government owned and private insurance companies; engineering & construction firms; companies operating in energy, oil and gas & shipping sector; banks and financial institutions and public sector undertakings, both in India and overseas. He is skilled in assisting clients with meeting the local requirements of multi-jurisdictional transactions while also focusing on the broader commercial objectives.
Debarshi regularly advises directors and officers in relation to civil and criminal liability exposure arising in course of fulfilling their corporate responsibilities. He is adept at handling a variety of commercial disputes for high net-worth individuals, particularly in the areas of mining, pharmaceuticals, commodities, intellectual property and financial services. Besides dispute resolution, he has substantial experience in corporate advisory work with a special focus on insolvency and bankruptcy laws, shareholder’s disputes and corporate restructuring, white-collar crimes and employment law.
He regularly appears in various courts and tribunals, including regulatory bodies, across India as well as before arbitral tribunals in India and abroad. His ability to act for clients as a solicitor and plead in court as a counsel has helped him carve out a niche practice, and his clients seek him out for complex and high-value disputes that require a tailored and out-of-the-box approach. His reputation is built upon his proficiency in litigation which enables him to navigate the complexities of the legal system, meticulous preparation and fearless commitment to his client’s cases.
He is often appointed by the court as a Receiver in arbitration matters to protect the subject matter of the dispute and as a Commissioner to assist the court in recording of evidence in contentious suits.
Selective Experience Statement
- Representing a wholly-owned Indian subsidiary of a large Swedish construction and mining conglomerate in an arbitration against a port operator in the Southern region of India concerning disputes arising from a turnkey contract for installing conveyors and automated stackers.
- Representing a European maritime group in enforcement and execution of 4 foreign awards for USD 120 million against a conglomerate based out of United Arab Emirates.
- Representing a wholly-owned Indian subsidiary of an Australian construction company and securing an injunction against fraudulent invocation of a performance bank guarantee under an EPC contract for a global construction company.
- Representing a multinational consultancy company in an arbitration with the government of the State of Tamil Nadu involving disputes relating to the construction of a state highway and issues relating to latent defects.
- Representing a Fortune 500 company in an arbitration against the Government of West Bengal in respect of a contract for Project Management Consultancy Services for supervision and monitoring of works for reconstruction and remodeling of embankments.
- Representing a leading Indian company operating in the health insurance space against a multinational company in a domestic arbitration in respect of a dispute arising out of a Master Services Agreement concerning the use of its proprietary copyrighted software deployed by all major health insurance companies in India.
